Florida Personal Injury Protection (PIP) LAW

Even if a driver is the "at fault" party in an auto accident, PIP is the primary insurance in their treatment.  Although an auto accident victim may have medical insurance, it is secondary and may deny coverage or demand full reimubursement for treatment.  If the victim does not have PIP, often a family member or the "at fault" has auto insurance coverage that can pay for their medical bills, but this process often involves consulting a lawyer. 

 

Drivers may receive $10,000 in PIP benefits only if an Emergency Medical Condition (EMC) is filed within 14 days of the auto accident by one of the following healthcare professionals:

Doctor of Osteopathic Medicine (DO)

Physician Assistant (PA)

Nurse Practioner (ARNP)

Dentist

 

If a driver does not receive an EMC, they could be limited to $2500 or denied coverage.
